WNY Web Subscribers Agreement
TERMINATION:

To terminate your subscription you must send a letter, 2 to 3 days in advance, to:

Or an e-mail, two days in advance, to:

In either the letter or the e-mail you must state the following:
Name; user name; password; telephone number; address (physical address, no P.O. Box address); whether the subscription is on a monthly, quarterly, semi-annual, or annual basis.  We would also appreciate it if you would state the reason for termination, however, this last item is only a request.

There is no partial monthly credit at the time of termination.  
All other subscription terminations will be prorated on a monthly basis.

Billing

All customers are billed from the date they are activated to the last day of the month that they disconnect. All billing will be via e-mail 

All bills will be posted on or before the last day of each month and are due  immediately  . Payments not received ey are due will be considered "Past Due".  At that time the subscriber's internet connection will be terminated and e-mail invoice reminder will be sent to the subscribers showing the outstanding balance.

Late payments not received within three days of due date  will be assessed a $5.00 "late charge" per month unless prior arrangements have been made.  Maximum charge will be $30.00.

Consistently late payments will be subject to termination with no other notice given.  A disconnect fee of $15 will be assessed to those customers.

Suspended accounts are subject to a $10.00 reconnection fee if they decide to re-subscribe to WNY Web.

Checks returned for Non-Sufficient Funds will be debited against the customer's account and a fee of $35.00 plus bank charges per returned check will be debited  against the customer's account. 

Western New York Web (WNY Web) will maintain a customer service department to handle any billing disputes which are submitted by a subscriber whether by e-mail or in writing, NO DISPUTE WILL BE HEARD VIA A TELEPHONE CALL.  A formal dispute is to be written down and sent to us by either e-mail or through the U.S. Mail Service

Access Lines and Access Lines Charges
Access line charges by the TelCo are the responsibility of the customer.  The customer is solely responsible for ascertaining whether or not the access line they are assigned by WNY Web is, indeed, a local number and not long distance.  Any inquiries on this regard should be addressed to the client's Telephone Company.

Minimum Billing

After a subscriber joins WNY Web for any billing cycle, the subscriber agrees to pay WNY Web a $18.00 termination fee if the subscriber decides to leave or unsubscribe to WNY Web on or before the first 10 days of his/her initial day of subscription.
 

 
Payment Cycle Notice
 
Hard copy invoices are only sent to annual subscribers upon request.  All other subscribers are reminded of renewal cycles via an e-mail sent to them at the start of their payment period. If you wish to be mailed a hardcopy and are not a semi-annual or annual customer, you will be assessed a $2.00 shipping and handling fee.
 
Changes to Service or Policies

Once notice of changes have been displayed over the Internet via our web site, WNY Web reserves the right to adjust this agreement, price structure, operating regulations and/or may cease or revise any or all aspects of the service without prior notice. 

Unless otherwise agreed, subscriber's rights to use the service or to appoint users is not transferable and is subject to any limits established by WNY Web, or by a subscriber's credit card company if billing through a credit card. 

 
Subscriber Responsibilities

Subscribers will be responsible for and must provide all equipment including but not limited to computer, modem, telephone, etc. necessary to access the service. Subscribers nor their assigned users may reproduce, retransmit, redistribute, transfer, publish or commercially capitalize on any information, software or general content which they receive via the service. 

Subscribers shall pay, in accordance with the provisions of the Billing Option selected by the subscriber, any registration or monthly fees, connect time charges, minimum charges and other charges incurred by the subscriber or its designated users at the rates in effect for the billing period in which these occurred, including but not limited to charges for any purchases made through the Service and any surcharges incurred using any supplemental networks or networks or services other than the Service. Subscribers shall pay all applicable taxes relating to use of the Service by member or its designated users. Subscribers shall be responsible for all use of the Service accessed through the subscriber's or its designated user's password(s).

 
Warranties

Neither WNY Web nor any of its content providers, licensers, employees or agents warrant that the service will be uninterrupted or error free; make any warranty as to the results to be obtained from the use of the service. The service is distributed on an "as is" basis without warranties of any kind, either expressed or implied. Neither WNY Web nor anyone else involved in creating, producing or delivering the service shall be liable for any direct, indirect, special or consequential damages developing out of use of the service. Subscribers expressly acknowledge that the provision of this agreement shall also apply to the third party content.
